The victim of DV can be women or men and it does not have to be just physical violence. Financial, social or emotional abuses and controlling can also be a form of domestic violence. When there was no evidence of physical violence and the police were not called plus the alleged victim was a male, there is a higher level of difficulties in satisfying evidentiary requirement for the DV provision of a partner visa. This was our experience in a recent case. We took on the case, informed Home Affairs of our client’s the domestic violence incidents. We then engaged highly trained medical professionals and social welfare workers who patiently and thoroughly assessed our client’s claims and clearly identified our client’s experience was domestic violence. With a well-prepared submission accompanied by comprehensive detailed evidence, the outcome was prompt and positive for our client without DHA requesting any further evidence from independent experts on domestic violence.
